JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

It would appear from perusal of the first information report that one Satwant Patel was killed by Md. Jasimuddin and others and the assailants of the aforesaid case had been hiding themselves in a house. The police encircled the aforesaid house and arrested 14 persons of the aforesaid case and rifle, country made pistols and live cartridges are said to have been recovered from there.

Patna High Court Cr.Misc. No.18541 of 2016 (2) dt.02-05-2016 2/2 Contention on behalf of the petitioners is that for the occurrence of murder of Satwant Patel, Bhabhua P.S. case No. 52 of 2016 was registered but in the aforesaid case the petitioners were not made accused and, as a matter of fact, when after murder of aforesaid Satwant Patel the local people became furious, the petitioners had also taken shelter in the house out of fear and unfortunately, they were also arrested by the police and after that they were implicated in the present crime. It is further submitted that the petitioners do not have any criminal antecedent and are languishing in jail custody since long.

Considering the facts aforesaid and submission of the parties, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/ - (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabua, Kaimur in connection with Bhabua P.S. case No.53 of 2016.
