JUSTICE SANJAY PRIYA ORAL ORDER 19-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Atri P.S. Case No. 220 of 2016 instituted for the offence under Sections 302/34 of the Indian Penal Code.

As per written report the brother of the informant was taken away by Devendra Yadav (Ex-Mukhiya) and he did not return to the house. Thereafter, wife of brother of the informant enquired about him from Devendra Yadav but he did not give any clue. The informant went to search and found the motorcycle of his brother lying near Tipa Baba Asthan. He got knowledge in the village that dead body is lying in the river and informant went there and identified the dead body.

It has been submitted that Devendra Yadav has already

Patna High Court Cr.Misc. No.29541 of 2017 (3) dt.19-07-2017 2/2 been granted bail by a coordinate Bench of this Court vide order dated 8.4.2017 passed in Cr. Misc. 11640 of 2017. There is general and omnibus allegation against the petitioner.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Gaya, in connection with Atri P.S. Case No. 220 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
