The petitioner is languishing in custody since 21.02.2016 in connection with Minapur P.S. Case No. 67 of 2011 for the offences instituted under Sections 366(A)/34 of the IPC. The prosecution story, in brief, is that the informant's daughter, namely, Laxmi Kumari, aged about 15 years is a student of 9th class in Yaduni High School, Turki, Kharu. The petitioner is a classmate of Laxmi Kumari who had visited the informant's house once or twice. It is further alleged that on 02.03.2011 at 4.00 A.M. Laxmi Kumari was not found in the house. The informant has belief that the petitioner enticed away his girl with a view to marry her.

The petitioner is in custody since 21.02.2016 and the charge sheet has been submitted in the present case. From perusal of paragraph nos. 49, 50 and 51 of the case diary, it is evident that the victim and the petitioner were in love and they had performed marriage. Subsequently, at the time of pregnancy the victim died in course of treatment. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Minapur P.S.
