Petitioner is in custody since 21.12.2015 in connection with Bihta P.S.Case No.1029 of 2015 registered for the offence under Sections 302 and 120(B) of the IPC and Section 27 of the Arms Act.
As per the prosecution case is that the informant Sunil Kumar, gave his fardbeyan, before the police and according to the fardbeyan of the informant, it transpires that a dead body of deceased Raj Kishore Singh was lying near open place of Labour Colony, Dilawarpur and the said dead body is the father of the informant It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.17352 of 2016 (3) dt.24-05-2016 petitioner is in custody since 21.12.2015. Chargesheet has been submitted in the case. Petitioner has falsely been implicated in the present case. Except for the suspicion, there is no other material to suggest the implication of the petitioner. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to show the involvement of the petitioner in the present case. On behalf of the State, it has been submitted that the petitioner is not named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of ACJM, Danapur, Patna in connection with Bihta P.S.Case No.1029 of 2015.
