The petitioner apprehends his arrest in a case registered for the offence under Sections 366(A), 34 of the Indian Penal Code.
It is submitted on behalf of petitioner that petitioner is innocent and has committed no offence. The victim girl (daughter of the informant), in her statement recorded under Section 164 Cr.P.C., has denied entire entire prosecution case and submitted that out of her own will, she solemnized marriage with co-accused Rajiv Kumar and no one has forced her and now, she wants to live with him. Petitioner has got clean antecedent.
Considering the aforesaid facts and circumstances as well as statement of the victim girl recorded under Section 164
Patna High Court CR. MISC. No.65450 of 2021(3) dt.06-07-2022 2/2 Cr.P.C., let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura in connection with Madhepura P.S. Case No. 482 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
