02. 13.07.2017 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in a case registered for offences under Sections 30(a), 33 and 36 of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, four bottles of Nepali Wine each containing 300 ml, i.e., total 1.20 litres were recovered from the possession of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 13.05.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named is directed to be released
Patna High Court Cr.Misc. No.31712 of 2017 (2) dt.13-07-2017 on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I-cum Special Judge, Excise Act, Sheohar in connection with Purnahiya P.S. Case No. 28 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
