2. The petitioner seeks bail in connection with Session Trial No.70 of 2024 arising out of Bidupur P.S. Case No. 73 of 2023 registered for the offence under Section 302 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is the brother-in-law of the deceased and he is said to have assaulted the deceased with a bamboo stick. From the prosecution case it appears that this occurrence might have taken place as the petitioner would have been in a drunken state.

4. Learned counsel for the petitioner submits

Patna High Court CR. MISC. No.57757 of 2024(3) dt.26-10-2024 2/2 that petitioner has clean antecedent and he is in jail since 10.02.2023.

5. Learned APP for the State has opposed the prayer for bail of the petitioner.

6. Considering the aforesaid facts of the case, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge 10th Vaishali at Hajipur in connection with Bidpur P.S. Case No.73 of 2023, subject to the condition that he will cooperate in the trial.
