The petitioner seeks bail in connection with Fulwaria P.S. Case No.7 of 2017 registered under Sections 272, 273 and 420/34 of the Indian Penal Code besides Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that in course of checking of the vehicles by the police, one Tata Indica vehicle was searched and 1350 bottles, kept in 30 cartoons, each cartoon containing 45 bottles, each bottle containing 200 ml. country made liquor, were recovered and the petitioner was apprehended. Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.16620 of 2017 (3) dt.30-06-2017 2/2 submits that, in fact, the petitioner was sitting in the said vehicle being a passenger and the owner of the vehicle succeeded to flee away. The petitioner having no criminal antecedent is in custody since 06.01.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XIII, Gopalganj, in connection with Fulwaria P.S.
