JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-11-2019 After hearing the parties, Patna High Court Mediation Centre observed as follows:- "1. That after great persuasion petitioner offered to pay Rs.5,00,000/- (Rupees Five Lakhs) as full and final one time settlement of amount mentioned above between the parties. Opposite Party No.2 (Madhu Kumari) accepted the offer and given consent to finally compromise this case i.e. Khanpur P.S.Case No.61 of 2019 pending in the court of S.D.J.M., Samastipur against petitioner as well as Matrimonial case No.160 of 2019 filed by the petitioner for seeking divorce against the Opposite Party No.2 pending in the Court of Learned Principal Judge, Family Court, Darbhanga.

2. That the petitioner agreed to pay Rs.2,00,000/- (Rupees Two Lakhs) through Demand Draft in favour of Opposite Party No.2 before the Hon'ble Court at the time of hearing of his bail application.

3. That the petitioner further agreed to pay Rs.1,50,000/- (Rupees One Lakh Fifty Thousand) at the time of filing compromise petition through Demand Draft in favour of Opposite Party No.2 in Khanpur P.S.Case No.61 of 2019 pending in the court of S.D.J.M., Samastipur.

4. That the petitioner further agreed to pay Rs.1,50,000/- (Rupees One Lakh Fifty Thousand) through the Demand Draft in favour of Opposite Party No.2 at the time of filing mutual consent of seeking divorce by the Opposite Party No.2 in Matrimonial case No.160 of 2019 pending in the Court of Learned Principal Judge, Family Court, Darbhanga.

5. That both parties also agreed to not said to be claim anything in future against each other.

6. That both parties also agreed to compromise the case and they do not want to proceed with the cases pending in between them. So the Khanpur P.S.Case No.61 of 2019 and Matrimonial case No.160 of 2019 may be treated as compromised and finally settled between the parties.

7. That the statements made in aforesaid paragraph are true to may knowledge and information."

In view of the aforesaid terms and conditions of agreement, petitioner has agreed to pay Rs.5,00000/- (five lacs) as full and final amount in one time settlement amount to Opposite Party No.2. Pursuant to aforesaid order, petitioner is paid Rs.2,00000/- (two lacs) to the learned counsel for the informant, namely, Mrityunjay Kumar by demand draft bearing no.589515 dated 21.09.2019.

The provisional bail order dated 19.08.2019 is hereby confirmed.
