The petitioner seeks pre-arrest bail in connection with Bihta P.S. Case No. 520 of 2017 registered under Sections 147, 148, 149, 406, 379, 120B of the Indian Penal Code, 4, 21 of the Mines and Minerals (D & R) Act, 1975, Section 4, 40 of the Bihar Mines Minerals Concession Rules, 1972 and Section 8 of the Bihar Minerals and Prevention of Illegal Mining Transportation Rules 2003.

Considering the fact that co-accused Dilip Kumar,

Patna High Court Cr.Misc. No.35867 of 2018 (2) dt.02-07-2018 Anil Kumar @ Anil Kumar Singh @ Anil, Niranjan Kumar, Pankaj Kumar and Kamdeo Singh having more or less identical allegation to that of the petitioner have already been granted prearrest bail by different Benches of this Court vide orders as contained in Annexures-3 to this petition, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur in connection with Bihta P.S. Case No. 520 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
