The petitioner being the husband of the victim is languishing in custody since 04.05.2015 in a case registered for the offences punishable under sections 341, 326, 307, 498A of the Indian Penal Code, subsequently, section 302 IPC was also added in connection with S.T. No.258/2015 (arising out of Chandan P.S. Case No.41/2015), pending before the learned 4th Additional Sessions Judge, Banka.

It is alleged against the petitioner that he assaulted with axe on the head of the daughter of the informant, who subsequently succumbed to the injuries. The occurrence took place after nine years of marriage. It is also alleged that earlier the demand of motorcycle was made by the petitioner.

Patna High Court Cr.Misc. No.18809 of 2016 (3) dt.19-05-2016 2/2 It is submitted by learned counsel for the petitioner that the informant is mentally abrased and actually none saw the petitioner assaulting the informant.

Considering the nature of accusation, this court is not inclined to grant bail to the petitioner at present. Accordingly, the application for bail on behalf of the petitioner is rejected. It is expected from the trial Court to expedite the trial.
