The petitioner apprehends his arrest in connection with Hajipur Sadar P.S. Case No. 262 of 2011 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
It is submitted on behalf of the petitioner that the present case has been lodged after long span of nine years for not depositing the sale proceeds of 1535.12 quintals food grains amounting to Rs. 21, 03,114.40 in the Government Funds for the year 2002-2003 to 2005-2006 under the SGRY Scheme. It is further submitted that the First Information
Patna High Court Cr.Misc. No.32457 of 2014 (2) dt.21-01-2015 2/2 Report is only confusing as whatever foodgrains had been distributed and if at all, there is any discrepancy in the accounts, the same should be accounted by the concerned officer and the petitioner may be asked a show cause for the same before filing any FIR. Petitioner undertakes that the discrepancy, if any, is found, he is ready to make payment of the same and as such, he may be extended the privilege of anticipatory bail.
Considering the aforesaid submissions and the fact that the petitioner is ready and willing to make payment of the same, if any, discrepancy is found, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 262 of 2011, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
