The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

It is alleged that the petitioners were partners in a construction company namely Maa Tara Construction. The J.C.B. loader machine of the company was in possession of the petitioners, but subsequently the petitioners refused to handover the J.C.B. loader machine to the informant. It is submitted by the learned counsel for the petitioners that due to dispute of repayment of the bank loan the accusation was levelled against the petitioners. The informant has retracted from the accusation and has filed a

Patna High Court Cr.Misc. No.31619 of 2014 (2) dt.03-02-2015 petition to that effect before learned court below, the same has been brought on record as Annexure-2. Statement has been made in para-3 that petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Triveniganj P.S. Case No. 16 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
