JUSTICE SUDHIR SINGH ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 272, 273 of the I.P.C. and Sections 30(a)/38/41 of the Bihar Prohibition and Excise Act, 2016. Allegation is that 3456 liters of foreign liquor was recovered from the truck.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.2.2017 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that 3456 of foreign liquor is said to have been recovered. The petitioner was the driver of the truck. He had no knowledge regarding the goods

Patna High Court Cr.Misc. No.29829 of 2017 (2) dt.07-07-2017 2/2 loaded in the truck. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge-cum-Special Judge, Excise, Muzaffarpur in connection with Brahampura P.S. case No.33 of 2017.
