The petitioner seeks bail in connection with Neema Chandpura P.S. Case No. 61 of 2016, registered under Sections 341, 323, 354, 376, 313, 504 and 506/34 of the Indian Penal Code.
The accusation is that on 02.05.2013 informant, who belongs to Harizan community, was alone in her house in the meantime, petitioner entered in her house and forcibly committed rape upon her. When she made complaint about lodging of the case then petitioner assured her to perform marriage with her. Thereafter, petitioner developed physical relation with her and she conceived pregnancy. Patna High Court Cr.Misc. No.24497 of 2017 (2) dt.30-06-2017 2/2 pregnancy has been aborted without her will. On 17.08.2016 informant asked to the petitioner and his family members regarding marriage, but they flatly refused to perform marriage with her.
Learned counsel for the petitioner submits that, in fact, due to village dirty politics the present case has been lodged on 13.09.2016 with respect to the occurrence of 02.05.2013. The petitioner is in custody since 12.04.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Begusarai in connection with Neema Chandpura P.S. Case No. 61 of 2016. (Rajendra Kumar Mishra, J) manish/- U T
