JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-01-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 498A and 494 of the Indian Penal Code.
The prosecution has been launched on the basis of a complaint petition made by the complainant. The petitioner nos. 1 and 2 are father -in-law and mother-in-law of the complainant. Petitioner no.3 is said to be the second wife of the husband of the complainant.
Learned counsel for the petitioners submits that there is no specific allegation of demand of dowry or torture, therefor, in
Patna High Court Cr.Misc. No.31562 of 2014 (3) dt.30-01-2015 the complaint petition against these petitioners. It appears that out of matrimonial dispute between the complainant and the husband Raslal Yadav, the present complaint petition has been filed. In view of the above, the petitioners above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Supaul in connection with Complaint Case No. 124 (C)/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
