The petitioners seek pre-arrest bail in connection with Parsa P.S.Case No. 129 of 2016 registered under Sections 341, 323, 406, 420, 379/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that as far as offences punishable under Sections 406 & 420 are concerned, they have been levelled against other coaccused persons. The allegation under Section 379 of Indian Penal Code is ornamental in nature and rest of the offences are all bailable. The petitioners are female members of same family and

Patna High Court Cr.Misc. No.36065 of 2018 (2) dt.03-07-2018 2/2 there implication is only because some dispute has taken place between the informant and co-accused Basudeo Mahto, who happens to be husband of petitioner no. 1 and father of petitioner no. 2.

Learned counsel for the State opposed the application for grant of pre-arrest bail of the petitioners. Considering the nature of allegation and the submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-13th, Saran at Chapra, in connection with Parsa P.S.Case No. 129 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
