====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 22-03-2023 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State and the learned counsel for the informant.

The petitioners are seeking regular bail in connection with Buxar Town P.S. Case No. 237 of 2022, registered for offence punishable under section 366 (A)/34 of the Indian Penal Code.

At the very outset, the learned counsel for the petitioners has submitted that the petitioners have falsely been implicated in this case merely because they are brothers of co-accused Amit Kumar against whom there was allegation of kidnapping of the minor daughter of the informant. The victim

Patna High Court CR. MISC. No.56337 of 2022(3) dt.22-03-2023 2/2 in her statement under section 164 of the Code of Criminal Procedure did not support the factum of kidnapping and she has stated that she went with Amit Kumar on her own sweet will. The victim has been produced before this Court from remand home and she states that she has solemnized marriage with Amit Kumar.

Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 237 of 2022, subject to the following condition:- The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
