JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Asarganj P.S. Case No. 14 of 2015, registered under Section 302/34 of the Indian Penal Code.

The accusation is that the petitioner along with Anoj Singh caused injury to the wife of the informant through knife, who succumbed to the said injury.

Learned counsel appearing on behalf of the petitioner submits that, in fact, the deceased and her daughter used to commit theft of onion and villagers have assaulted him, thereafter, a Panchyati was convened, but due to ulterior motive the petitioner and two others have falsely been implicated in this case. Further submission is that similarly situated co-accused,

Patna High Court Cr.Misc. No.17765 of 2016 (2) dt.29-04-2016 2/2 Anoj Singh, and Amar Singh have already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 30.01.2016 passed in Criminal Misc. Nos. 49619 of 2015 and Criminal Misc. No. 52771 of 2015, respectively. The petitioner having no criminal antecedent is in custody since 09.02.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Amit Kumar Sharma, Judicial Magistrate 1st Class, Munger in connection with Asarganj P.S. Case No. 14 of 2015.
