NATH ORAL ORDER 21-01-2015 Heard the learned counsel for the petitioner. The petitioner has prayed for anticipatory bail in connection with Bihariganj P.S. Case No. 162 of 2013 for the offence punishable under Section 302 of the Indian Penal Code. The learned counsel for the petitioner has submitted that the petitioner has not been named in the F.I.R. and no material has come in the case diary against the petitioner. It has further been submitted that the petitioner is a relative of the deceased lady and there is no reason as to why he would commit the murder. However, the fact has not been disputed that the investigation is going on.
In the facts and circumstances of the case and considering the submissions, this Court is not inclined to enlarge the petitioner on
Patna High Court Cr.Misc. No.31556 of 2014 (3) dt.21-01-2015 anticipatory bail.
Accordingly, the prayer for anticipatory bail is, rejected in connection with Bihariganj P.S. Case No. 162 of 2013 pending in the court of the learned Chief Judicial Magistrate, Madhepura. (V. Nath, J) Devendra/- U T
