JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 307 and 34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is that he along with other accused persons fired upon the cousin brother of the informant.

It has been submitted on behalf of the petitioner that he is in custody since 12.1.2016. Chargesheet has been submitted in the present case. As per allegation, petitioner is said to have fired causing no injury to the victim. The injury has been attributed against the co-accused, namely, Amit @ Sonu Yadav. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.16791 of 2016 (3) dt.23-05-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Saharsa Sadar P.S. Case no. 130 of 2015.
