The petitioner is accused in connection with Runnisaidpur P.S. Case No. 130 of 2012, registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that that petitioner is not named in the F.I.R. In course of investigation his name was come in the confessional statement of co-accused Rishi Jha, except the confessional statement there is nothing against the petitioner to show his involvement in the present case. Further submission is that since the petitioner is accused in 24 other cases, as detailed in para-03 of the petition, due to that
Patna High Court Cr.Misc. No.17782 of 2016 (2) dt.02-05-2016 2/2 reason Police implicated him in the present case. Further submission is that similarly situated co-accused Rishi Jha @ Rishi Kumar Jha and Mritunjay Tiwary have already been granted privilege of bail by this Court and by a Co-ordinate Bench of this Court vide order dated 05.03.2014 passed in Criminal Misc. No. 39119 of 2013 and order dated 21.05.2013 passed in Criminal Misc. No. 47249 of 2012, respectively. The petitioner is in custody since 30.08.2013.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 130 of 2012. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
