2. The petitioners seek regular bail in connection with Pipra P.S. Case No. 125 of 2024 registered for the offence punishable under Sections-21(c), 22(c), 25, 29 of the N.D.P.S. Act.

3. Allegedly, on the tip off, the informant along with police personnel intercepted a Scorpio bearing registration No. BR 19C 7777 and from that vehicle five accused persons (petitioners) were apprehended and on search, 107 litres of illicit codeine phosphate and wiscof cough syrup was recovered from the vehicle.

4. Learned counsel for the petitioners has submitted that they are the persons of clean antecedent. Nothing was recovered from their possession. They have falsely been implicated in the present case due to animosity with the police. It has also been submitted that the alleged contraband is cough syrup. The petitioners are in custody since 15-04-2024.

5. Learned counsel appearing for the State has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, specially the clean antecedent of the petitioners, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge (NDPS), Supaul with condition that the petitioners will appear in the court below on each and every date fixed in the case and if, they fail to do so on two consecutive dates unless they are prevented by extremely adverse circumstances, the learned court below shall be at liberty to cancel the bail bonds of the petitioners.
