Petitioner seeks regular bail in a case registered for the offence punishable under Section 363, 366 of the Indian Penal Code.

As per the prosecution case, this petitioner forcibly made the victim to sit in an auto and thereafter he and coaccused, Md. Nijam, took her to Bangalore. It is further alleged that Md. Nijam made physical relation with her and also made video clip and this petitioner made the video clip viral on social media.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that victim in her statement u/s 164 of the Cr. P. C. made allegation of sexual assault against co-accused,

Patna High Court CR. MISC. No.65795 of 2021(3) dt.18-04-2022 2/2 Md. Nijam and so far this petitioner is concerned, she has not leveled any allegation of sexual assault against him. Petitioner claims clean antecedent and is in custody since 08.06.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-XV, Muzaffarpur in connection with Aurai PS case No. 113/2019.
