1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Excise P.S. Case No. 741 of 2023 dated 21.07.2023 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

3. The main submissions advanced by learned counsel for the petitioner are that the instant matter relates to the recovery of 85.200 litres of country-made liquor and out of the seized liquor, 81 litres of liquor is stated to have been recovered from the joint house of this petitioner and 4.200 litres of liquor is stated to have been recovered from a scooty (TVS), of which the petitioner is not the registered owner and he had no concern

It is further submitted that the petitioner has fair and clean antecedent and has been languishing in jail since 22.07.2023 and against him, the investigation has been completed.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly the petitioner's young age as mentioned in the petition as well as his fair and clean antecedent, this Court is inclined to accept the bail prayer of the petitioner. Accordingly, let the petitioner namedabove be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Excise P.S. Case No. 741 of 2023.
