The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 302 and 120B of the Indian Penal Code.

It is alleged that the informant's uncle Amod Kumar was assaulted by the petitioner and other co-accused persons. Subsequently, neck of the informant's uncle was slit by coaccused, Upendra Kumar. Learned counsel for the petitioner submits that the petitioner has been roped in the present case since the petitioner is the agnate of the informant and the informant had been on inimical term with the petitioner. Moreover, for the alleged occurrence of 03.03.2019 at 6.00 P.M., the FIR was registered on 04.03.2019

Patna High Court CR. MISC. No.52638 of 2019(3) dt.16-11-2019 2/2 at 8.30 A.M. The post-mortem of the victim suggests the injury caused by hard and blunt substance.

Keeping in view of the fact that the post-mortem reflects the injury on the neck of the victim caused by co-accused Upendra Kumar, it is a case for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if he surrenders within a period of six weeks in connection with Wazirganj P.S. Case No. 67 of 2019, pending before the learned CJM, Gaya.
