The petitioner is languishing in custody since 21.05.2015 in connection with Ara Nawada P.S. Case No. 184 of 2015 for the offences instituted under Sections 394 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that while the informant alongwith guard of the company was going to deposit money of the company from the motorcycle in the bank some miscreants snatched money from the informant and caused fire arm injury to the guard.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.05.2015 and the charge sheet has

Patna High Court Cr.Misc. No.20430 of 2016 (3) dt.19-07-2016 2/2 been submitted in the present case. There is no allegation of tampering with the evidence against the petitioner. The petitioner has been made accused on the basis of confessional statement of a co-accused. Except for this, there is no substantive material to implicate the petitioner in the present case. The other co-accused has been granted bail by this Court vide Cr. Misc. No. 36609/2015.

On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara, in connection with Ara Nawada P.S.
