Petitioner is accused in connection with Chousa P.S. Case No. 04 of 2016 registered under Sections 25(1-B)A, 26 of the Arms Act.
The accusation is that the petitioner was apprehended by the Police and on search, one country made pistol and 21 live cartridges of .315 bore were recovered in presence of two independent witnesses.
Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case. It is also submitted that while the petitioner is accused in 5 other cases, as detailed in paragraph no.3 of the petition, but in two cases, he
Patna High Court Cr.Misc. No.17748 of 2016 (2) dt.29-04-2016 2/2 has been acquitted and in rest three cases, he is on bail. It is further submitted petitioner is in custody since 08.01.2016. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M., 1st Class, Udakishunganj, Madhepura in connection with Chousa P.S.
