JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 04-02-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Jankinagar P.S. Case No. 108 of 2021, registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The learned counsel for the petitioner has submitted that one country-made pistol was recovered from vehicle, which was parked in the premises of co-accused Saurav Kumar. Two cases for the same occurrence were lodged in Jankinagar P.S. Case No. 107 of 2021 against the petitioner, which has been lodged under the provisions of Bihar Prohibition and Excise Act. The petitioner has been granted bail. He was not arrested at

Patna High Court CR. MISC. No.54615 of 2022(2) dt.04-02-2023 2/2 the spot. Nothing was recovered from his possession. On the other hand, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Jankinagar P.S. Case No. 108 of 2021, subject to condition as laid down under section 438(2) Cr. P.C.
