JUSTICE AJAY KUMAR TRIPATHI) Date: 23-11-2017 This writ application will be treated to have become infructuous for two reasons, one, that the necessary amendment in Rule 8(1) of the Indian Forest Service (Probation) Rules, 1968 has been amended, and secondly, because of the interim order of the court, the petitioner participated in the civil services examination and has been successful with exemplary rank in service.

In view of the same, the writ application is

Patna High Court CWJC No.12924 of 2015 dt.23-11-2017 allowed. The impediment which was sought to be created by the Union of India by the Rule, as it existed then, is of no avail now in the changed circumstances.

The impugned order dated 23.07.2015 (Annexure5 to the writ application) stands quashed. The writ application is disposed off.
