JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This is an application for grant of anticipatory bail in connection with Kotwali P. S. Case No. 629 of 2017, disclosing offences under Sections 409, 417, 418, 419, 420, 461, 468, 504, 506, 120B of IPC.
It appears that earlier prayer for anticipatory bail of the petitioners have been rejected by a Co-ordinate Bench of this Court, vide order dated 21.05.2018 passed in Criminal Misc. No. 9095 of 2018 and later on, petitioners have also moved before the Hon'ble Apex Court and S.L.P. filed by the petitioners has also been rejected by the Hon'ble Apex Court. Submission of the learned counsel for the petitioners is that a new development has taken place and a compromise has been reached between the parties. They have already paid
Patna High Court CR. MISC. No.52161 of 2019(3) dt.05-11-2019 2/2 the amount and as such, they came for anticipatory bail before this Court.
Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioners on the ground that they are coming after a year of the rejection of the anticipatory bail, which has already been rejected by the Hon'ble Apex Court.
Having heard both sides, considering the above stated facts, I am not inclined to grant privilege of anticipatory bail to the petitioners. It is always open to the petitioners to surrender and pray for regular bail before the learned court below, which will be considered on the basis of the submissions made above.
