JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioners and the State. The petitioners are accused in a case registered under Sections 147, 302, 120( B ), 379 of the Indian Penal Code. Accusation is that nine persons named in the FIR and five unknown persons were celebrating 1st January, 2016 and they were in drunken state. In that course they assaulted Rahul Kumar son of the informant and pushed him into a well. On hearing hulla, the informant and other villagers came there and took out the son of the informant from well and rushed for treatment in P.H.C. Barahatty where he died.
Learned counsel appearing on behalf of the petitioners submits that, in fact, the informant is not the eye
Patna High Court Cr.Misc. No.19721 of 2016 (2) dt.11-05-2016 2/2 witness of the occurrence and the son of the informant, who was also in drunken state, fell down in the well but due to ulterior motive the present case has been lodged and the petitioners have falsely been implicated in the present case. He further submits that the petitioners having no criminal antecedent are in custody since 12.01.2016.
Having considered the facts and circumstances of the case, let, above named petitioners, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, District- Gaya in connection with Barachatty (Mohanpur) P.S.Case No. 2 of 2016.
