The petitioner is accused in connection with Sessions Trial No. 208 of 2016 arising out of Kajraili P.S. Case No.44/2015 registered under Sections 302 and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has come in the confessional statement of co-accused Saukat @ Md. Saukat, who has stated that the petitioner has planned for committing murder of the deceased. Except confessional statement, no tangible material has been collected during investigation. Case No. 44/2015.
