The petitioner apprehends his arrest in connection with Makhdumpur P.S. Case No. 218 of 2019, registered under Section 25(1-b)a, 26 of the Arms Act, pending in the court of the S.D.J.M. Jehanabad.

The accusation is of recovery of three 8 mm bore country made gun from the house of petitioner kept in a sack. Learned counsel appearing on behalf of the petitioner submits that at the time of seizure of alleged country made guns, the petitioner was not at his house. The petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am

Patna High Court CR. MISC. No.51440 of 2019(2) dt.19-08-2019 2/2 not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
