JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code. The present case was lodged against unknown person but it appears from perusal of the impugned order that petitioner was caught with stolen motorcycle in course of investigation.

Submission on behalf of the petitioner is that the seized motorcycle was lying on the road and petitioner was standing there and the police caught the petitioner on mere suspicion. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 31.01.2016.
