JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 The anticipatory bail application of petitioner no. 3 Baidyanath Yadav has already been disposed off by this Court vide order dated 20.10.2014 since he has been arrested.

Heard learned counsels for the petitioners and the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 341 and 307 of the Indian Penal Code.

It is alleged that the petitioner nos. 1 and 2 assaulted the informant and his parents. Assault was also made by petitioner no. 2 causing uprooting the teeth of the mother of the informant.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.31896 of 2014 (3) dt.19-02-2015 2 / 2 petitioners that except one injury of mother of the informant all injuries of the informant and his father have been found to be simple. There is counter version of occurrence also.

For the occurrence of 07.08.2013, complaint was filed on 16.08.2013 which came to be registered as police case on 07.02.2014. A statement has been made in paragraph no. 3 of the petition that the petitioners have no criminal antecedent.

Considering delayed filing of the complaint, let the petitioners, Anandi Yadav, Khagesh Kumar and Rajesh Kumar above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Kumarkhand P.S. Case No. 32 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Madhepura, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
