The petitioner seeks bail in connection with Nathnagar Police Station Case No.272 of 2015 registered under Sections 380 and 411 of the Indian Penal Code.

The accusation is that in course of decoration of 'Mundap' on the occasion of marriage of the niece of the informant, the wife of the informant had kept her purse containing cash Rs.7000/-, ATM Card, golden 'Mangaltika' and one 'Tabeez' but in a short interval that was found missing and on query, it was learnt that one boy, who was engaged in decoration of the 'Mundap', had come near the bed and on search, he was found at Khalipabagh Chowk and from his possession cash Rs.4300/-, Tabeez, golden 'Mangaltika' were recovered and the

Patna High Court Cr.Misc. No.19475 of 2016 (2) dt.05-05-2016 2/2 boy disclosed his name as Amit Kumar Rai (petitioner). Learned counsel appearing on behalf of the petitioner submits that, in fact, nothing has been recovered from the possession of the petitioner and on mere suspicion, the petitioner has been implicated in this case showing the recovery of the aforesaid articles. Further submission is that the petitioner having no criminal antecedent is in custody since 10.12.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Nathnagar Police Station Case No.272 of 2015. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
