The petitioner is accused in connection with Muffasil P.S. Case No.44/2016 registered under Sections 341, 327, 379, 448, 504, 506, 376, 511 read with Section 34 of the Indian Penal Code.

The prosecution case is that the informant after coming from Ambala, came at his house at 1.00 hour in the night. While he was cleaning the mouth, in the meantime this petitioner along with three others entered in his house armed with lathi, danda and started assaulted him and when his wife came to save him, she was also abused in filthy language and thrown on the ground. At that time, this petitioner taken away Rs. 3500/- from

Patna High Court Cr.Misc. No.17790 of 2016 (2) dt.29-04-2016 the bag of the informant and fled away after giving threatening of dire consequences.

Learned counsel for the petitioner submits that the petitioner and the informant are next door neighbour and due to some dispute and grudge, the petitioner has been falsely implicated in this case. Moreover the petitioner has no criminal antecedent and is in custody since 01.03.2016. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Muffasil P.S.
