1. The present petition has been filed for restoration of a petition bearing Cr.Misc.No. 74784 of 2022, which has stood dismissed for default on account of non-compliance of the peremptory order dated 06.02.2023.

2. The learned counsel for the petitioner submits that though the defects have been removed now, however, the same could not be removed within time on account of certain unavoidable reasons, hence the aforesaid petition be restored.

3. Having regard to the facts and circumstances of the case and considering the submissions, made by the learned counsel for the petitioner, though I deem it fit and proper to restore the aforesaid petition bearing Cr.Misc.No.74784 of 2022 to its original file, however, subject to the Registry verifying as

Patna High Court CR. MISC. No.74532 of 2023(2) dt.24-11-2023 2/2 to whether all the defects, as pointed out by the Registry, has stood removed or not.

4. The petition stands disposed off on the aforesaid terms.
