JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-326, 307, 435 & other minor sections of the Indian Penal Code.

Petitioner and his associates are said to have attacked on police party but submission on behalf of petitioner is that the petitioner was granted the privilege of anticipatory bail by a coordinate bench of this court vide order dated 13-02-2014 passed in Cr. Misc. No. 26964 of 2013 but unfortunately, the aforesaid order was not communicated to the petitioner as a result whereof, he could not surrender before the court below. Moreover, the petitioner was arrested by the police and was sent to judicial

Patna High Court Cr.Misc. No.18167 of 2016 (2) dt.03-05-2016 2/2 custody on 13-10-2015 and since then, he is languishing in jail custody.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mirganj P.S. Case No. 67 of 2012 to the satisfaction of Sri P.K. Mohit, learned Additional Chief Judicial Magistrate, Purnea.
