No one appears for the State.

The petitioner in the present case is seeking regular bail in Complaint Case No. C2-200 of 2017 under Section 30(A) of the Bihar Excise and Prohibition Act, 2016. Learned counsel for the petitioner referring to Annexure-1, which is the F.I.R. together with the Seizure Memo, submits that the allegation is that of a seizure of NML (SOUFI) - 160 bottles, each containing 300 ml, and a motorcycle for a total value of Rs. 54,600/-. Learned counsel submits that the petitioner has no criminal antecedent and has been falsely implicated in this case due to some village politics. Nothing has been recovered from his conscious possession and he has no criminal history. The

Patna High Court Cr.Misc. No.27460 of 2017 (2) dt.01-07-2017 2/2 petitioner is in judicial custody since 05.04.2017 and, therefore, he may be released on bail.

Considering the facts and circumstances of the case as also the submissions made here-in-above, let the petitioner, namely, Manoj Rai be enlarged on bail on his furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Sitamarhi in Complaint Case No. C2-200 of 2017, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
