The petitioner apprehends his arrest in Barachatti P.S. Case No.453 of 2017 registered under Sections 420, 406, 384 and 120(B) of the Indian Penal Code.
The Block Development Officer alleged that complaint is received that some persons are taking illegal money from the beneficiaries of Prime Minister Awas Yojna.
The learned counsel for the petitioner submits that the petitioner did not receive any money from Pramila Devi. Pramila Devi made false allegation. No other persons have supported the version of Pramila Devi.
Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the
Patna High Court Cr.Misc. No.34598 of 2018 (2) dt.02-07-2018 petitioner denied to have received any money from the beneficiary of Prime Minister Awas Yojna, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Barachatti P.S. Case No.453 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
