Petitioner seeks bail in a case registered under sections 302 and 394 of the Indian Penal Code.

Petitioner is not named in the first information report and his name surfaced in this case in the confessional statement of coaccused Pappu Kumar and on the basis of the aforesaid confessional statement, petitioner is languishing in jail custody since 11.2.2016 but up till now, he has not been put on T.I. Parade, particularly, in the circumstance, when the informant claims that she can identify the culprits, if they are produced before her.

Moreover, co-accused Santosh Mahto and Pappu Kumar have already been granted privilege of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on

Patna High Court Cr.Misc. No.19131 of 2016 (2) dt.05-05-2016 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge, Rosera at Samastipur in Sessions Trial no. 101/2016 arising out of Bibhutipur P.S. Case no. 38/2014.
