Earlier prayer for bail of the petitioner has been rejected vide order dated 23.2.2017 passed in Cr.Misc.No. 7961 of 2017 with an observation to renew prayer for bail before the court below after submission of charge-sheet in this case. Submission of learned counsel for the petitioner is that after submission of charge-sheet petitioner has moved the lower court but his prayer for bail has been rejected. Heard learned APP also.
Having heard both sides and considering the aforesaid facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to
Patna High Court Cr.Misc. No.30060 of 2017 (3) dt.19-07-2017 2/2 the satisfaction of the Sessions Judge, Kishanganj, in connection with Sessions trial No. 57 of 2017, arising out of Terhagachh P.S.Case No. 49 of 2016, G.R.No.1230 of 2016, subject to the conditions that :- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable properties within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available on each and every date, failing which his bail bond shall be cancelled. (Vinod Kumar Sinha, J) spal/- U
