JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 28.05.2014 in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.
The Block Supply Officer, Maner, on information that PDS Dealer, Dev Sahay Singh and this petitioner are selling the kerosene oil in the black market, raid was led when neither any stock register nor cash-memo nor any grain or kerosene oil was found though, seizure was made from the adjacent house. Though, 2500 liters kerosene oil were supplied in February, 2014 for being distributed to the consumers at the rate of Rs. 20/- per liter. It is submitted by learned counsel for the petitioner that the petitioner is the employee of the PDS dealer, hence no offence under Section 7 of the Essential Commodities Act is made against
Patna High Court Cr.Misc. No.33295 of 2014 (4) dt.09-01-2015 2/2 the petitioner.
Considering the nature of accusation and period under custody, let the above named petitioner, be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Subdivisional Judicial Magistrate, Danapur in connection with Maner P.S. Case No. 59 of 2014.
