JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 20.2.2015 in a case registered under Sections 302, 201 and 34 of the Indian Penal Code.
Petitioner happens to be husband of the deceased and according to prosecution case itself, the marriage of the deceased had solemnized with petitioner 14 years ago. The informant claims that deceased was subjected to torture and cruelty due to nonfulfillment of illegal demand of ornaments, but submission on behalf of the petitioner is that after such long period of marriage, the allegation of illegal demand does not appear to be convincing. Moreover, the deceased died of her natural death and after
Patna High Court Cr.Misc. No.20425 of 2016 (2) dt.13-05-2016 2/2 cremation of the dead body, the informant lodged this case at the instigation of enemies of the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Gaya in connection with Konch P.S. Case No.58 of 2014.
