NILU AGRAWAL ORAL ORDER 18-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner apprehends his arrest in connection with Benipatti P.S. Case No. 140 of 2014, G.R. No. 2150 of 2014 registered for the offence under Sections 307, 379 and other allied sections of the Indian Penal Code.

Earlier, petitioner had approached this Court for grant of anticipatory bail in Cr. Misc. No. 8207 of 2016 wherein under order dated 25.02.2016, it was observed that there is specific allegation against the petitioner, hence, he was directed to surrender before the learned Court below within a period of six weeks and the learned Court below was directed to consider his prayer for regular bail, but in spite of the said direction, petitioner

Patna High Court Cr.Misc. No.21414 of 2016 (2) dt.18-05-2016 2/2 did not surrender. Learned counsel for the petitioner also did not point out any fresh cause of action.

Under such circumstances, petitioner is directed to surrender in the Court of learned Sub-Divisional Judicial Magistrate, Benipatti, Madhubani in connection with Benipatti P.S. Case No. 140 of 2014, G.R. No. 2150 of 2014 and apply for regular bail, which shall be considered on its own merit preferably on the same day.
