Petitioner seeks bail in connection with Mithanpura P.S. Case No. 105/17 for the offences alleged under Sections 25(1B)a/26/35 of the Arms Act. The prosecution case, as lodged by the police personnel, is that one unknown criminal was on lurch, the police apprehended the petitioner and upon search one revolver and one mobile set was recovered. He disclosed that the said revolver has been given to him by Basant Kumar and Rajiv Kumar. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history for similar offence and that he is in jail custody since 13.04.2017. He submits

Patna High Court Cr.Misc. No.30101 of 2017 (2) dt.06-07-2017 2/2 that no overt act has been committed by the petitioner and the petitioner has been made accused only on the basis of suspicion. However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, East, Muzaffarpur in connection with Mithanpura P.S. Case No. 105/17.
