JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402 of the Indian Penal Code and under Sections25(i-B)A/26/35 of the Arms Act. Petitioner and some others were caught, when the petitioner and others had assembled to make preparation for committing dacoity and it is stated that one loaded country-made pistol and 7 live cartridges were recovered from possession of the petitioner. Petitioner carries criminal antecedent of four cases but prior to institution of the present case, no case of dacoity or loot had been registered against him. Moreover, investigation against

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Hilsa P.S. Case No. 550 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Hilsa, Nalanda.
