JUSTICE SANJAY PRIYA ORAL ORDER 2/ 11-07-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Ara Town P.S. Case No.481 of 2017 instituted for the offence under Section(s) 406, 409, 420, 467, 468, 471, 120-B/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Ara, Bhojpur.

Prayer of the petitioner for grant of anticipatory bail was earlier rejected by this Court by order dated 26.03.2018 passed in Cr. Misc. No.9190 of 2018.

This second anticipatory bail application has been filed on the ground that Director of M/s V. K. Enterprises, Vipin Kumar @ Vipin Chaudhary, had filed CWJC No.6773 of 2014,

Patna High Court Cr.Misc. No.37000 of 2018 (2) dt.11-07-2018 2/2 which was disposed off on 20.01.2016, granting liberty to the petitioner-Company to move for arbitration making claim for payment as per the work done.

Since prayer of the petitioner for grant of anticipatory bail was rejected by this Court on merit after discussing entire case, this Court does not find it proper to reconsider the prayer for anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is, again, rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law, preferably on the same day, without being prejudiced by this order.
